Your box can stay in our warehouse in the city of its final destination for a maximum of 40 days. If we did not receive your payment for the invoice, we will consider you have abandoned your box(es), and that you agree for them to be destroyed or sold in auction.

Shipper Responsibilities

The sender is SOLELY responsible for the inventory list established and for its declaration as Personal or Commercial Effects. In the event of refusal by customs or government services at the final destination city, the customer will pay the surcharges before delivery to the recipient.

The weight check upon arrival is the ONLY check taken into account.

The recipient may under no circumstances refer to the list established by the sender and not countersigned by Trusted Cargo company at the final destination city. The sender certifies that the contents of the packages are neither dangerous for transport nor prohibited by the authorities.

Non-Compliance with Regulations

Failure to comply with the regulations will result in a fine and/or confiscation of the illegal goods by the applicable authorities.

Specific Requirements

1. Requirements for textile products

Textile products, especially those destined for South Africa, must have sewn-in care labels, composition labels, and "Made in China" labels. These three labels are mandatory for all standard-compliant and qualified products.

2. Dimensional restrictions for shipping :

  1. If an item weighs more than 70 kg or has a side length exceeding 180 cm, an oversize freight charge of USD 35 (R 625) per shipment will be charged (maximum of 10 items per shipment; an additional USD 8 (R 125) per item will be charged for any excess). A 9 cm wooden base (pad) is required.
  2. If an item weighs more than 150 kg or has a side length exceeding 200 cm, an oversized freight charge of USD 70 (R 1250) per shipment will be charged (maximum 10 items per shipment; an additional USD 10 (R 170) per item will be charged for any excess). A 9 cm wooden base (skid) is required.

For goods exceeding 3 meters in length or 1000 kg, please consult us separately. Additional handling charges, such as forklift or crane charges, may apply and will be charged based on actual costs.

Right of Refusal

The sender reserves the right to refuse certain goods (including animals, certain jewelry, postal orders, identity documents, bonds, checks, currency, drafts, securities, traveler's checks, etc.), to refuse to handle dangerous goods, and to prohibit those determined in particular by national and international laws and regulations.

The goods are accepted without verification of their contents and condition. Neither verification of the information provided nor the weights declared by the customer are obligatory for the sender. The sender or the competent authorities have the right, if necessary, to verify the contents of the shipments.

Furthermore, the customer guarantees that the goods are packaged to ensure safe transport with respect to ordinary handling.

Transport Conditions

The sender has complete freedom to determine the manner and means by which the goods will be transported. All necessary information (shipping marks on the box as instructed, etc.) must appear clearly on all shipments.

In the event of refusal of the goods by the recipient or failure of the latter for any reason whatsoever, the customer will bear all costs relating to the change of destination of the goods or possibly their repatriation and storage.

Payment and Billing

All invoices are payable upon receipt by the customer, i.e. at the sender's counter or through the payment link that will be sent to him/her, prior to shipment. If the rates for transport and other services are not paid prior to shipment, all charges shall be paid within 5 days of receipt of the invoice, which shall be deemed to have been received 3 working days after the invoice date, unless proven otherwise

If any duties, taxes, fines, fees or expenses are imposed or incurred due to any action by customs or the failure of the sender or consignee to provide the appropriate documents or any license or permit required in connection with the transport, they shall be charged in advance to the consignee and, in the absence of payment by the latter, it shall then be the customer's responsibility to pay the amount in question upon simple demand.

Amounts unpaid on their due date will automatically and without prior notice bear interest at the annual rate of 12% plus a fixed compensation equivalent to 15% of the debt with a minimum of USD 50 (R900), intended to cover the economic and administrative damage suffered, without prejudice to the sender's right to prove the existence of greater damage

The sender has a lien on all goods transported for freight, customs duties, sums advanced and all other charges resulting from the transport. The sender also has a right of retention on the goods and is entitled to sell them in order to fully cover his costs, after formal notice has remained unanswered for 15 days.

Limitation of Liability

The shipper shall only be liable for its own faults and negligence in the performance of its mission, provided that these have caused direct material or financial damage to the client, excluding any indirect damage, particularly economic

The shipper assumes no liability if the damage suffered is, even in part, due to a case of force majeure or the fault of a third party or the client.

When incurred, the shipper's liability is limited, unless expressly agreed otherwise, to USD 5 (R 90) per kilogram of gross weight damaged or lost, with a maximum of USD 25,000 (R 450,000) per mission.

Delivery Deadlines

Delivery times are not guaranteed by the shipper, unless otherwise agreed in advance and in writing. The mere mention of a delivery time by the client does not bind the shipper in any way.

Claims

To be admissible, any claim must be addressed to the sender by registered letter within 14 days of dispatch or delivery.

If the recipient fails to take delivery, the 14-day period begins when the goods concerned are made available to the person authorized to receive delivery.

Statute of Limitations

Any liability claim against the sender is barred by prescription if it is not brought before a competent court within six months from the day following the day on which the goods were or should have been delivered or, failing that, from the day following the day on which the Event giving rise to the claim occurred.

Legal Jurisdiction

Only the courts of the judicial district of the warehouse of the city of final destination of the package shall have jurisdiction, without prejudice to the sender's right to bring the dispute before another jurisdiction.

Under these conditions, any contract concluded that incorporates them, and, in general, the entire relationship between the sender and the customer, shall be governed by South African law for the warehouse located in South Africa, and Congolese law for the warehouse located in the Democratic Republic of Congo.

By submitting and paying this Invoice, you agree to the terms and conditions of use of Trusted Cargo Company.

All our transactions are subject to the general terms and conditions set out in this framework.

Our contractors acknowledge that they are fully aware of these terms and conditions and declare that they have accepted them.
